Terms of Use

1. Agreement and eligibility

These Terms of Use form an agreement between you and TOBEHO LLC, a Delaware limited liability company, for your use of Tobeho. By creating an account or using the service, you agree to these Terms and the Community Guidelines and acknowledge the Privacy Policy.

You must be at least 18 years old and legally able to enter into this agreement. Do not use Tobeho if you do not meet these requirements.

2. The service

Tobeho is a social rating platform. Eligible users can create profiles, send and receive rating requests, submit ratings after a request is accepted, manage rating visibility and use reporting and account-management tools.

Ratings and written notes are user-provided opinions. They are not professional, medical, employment, credit or other formal assessments, and should not be treated as such.

3. Accounts and security

You must provide accurate information, keep your login details secure and use only accounts you are authorized to control. You are responsible for activity carried out through your account unless you promptly report unauthorized access.

You may not create accounts through bots, use disposable or unauthorized identifiers, impersonate another person or evade a restriction, suspension or deletion decision.

4. Ratings and other content

You retain ownership of content you submit. You give Tobeho a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format and process that content only as reasonably needed to provide, operate, secure, moderate, maintain and support the service and to comply with law.

You must have the right to submit your content. Do not submit content that is unlawful, misleading, harassing, threatening, discriminatory, sexually exploitative, privacy-invasive, defamatory, fraudulent or infringing.

Completed ratings may remain in anonymized form after an account is deleted, as explained in the Privacy Policy. Content removed through moderation remains subject to the applicable retention rules.

5. Acceptable use

You must follow the Community Guidelines. In particular, you may not manipulate ratings, coordinate fake activity, scrape or overload the service, interfere with security, distribute malware, collect personal information without authorization or use Tobeho to target, intimidate or deceive others.

6. Moderation and account actions

Tobeho may review reports and take proportionate action, including limiting a feature, removing content, requiring a username change, suspending access, scheduling account deletion or permanently closing access where permitted. Available appeal or review options depend on the type of decision.

We may preserve limited records when reasonably needed for security, abuse prevention, legal obligations or dispute handling. Details are described in the Privacy Policy.

7. Paid plan upgrades

Paid plans are one-time, non-recurring account upgrades. They do not renew automatically and do not create subscription charges. A plan upgrade is applied after payment is successfully confirmed.

Except where applicable law requires otherwise, Tobeho will refund a payment only if we receive it and the purchased plan upgrade is not delivered. Dissatisfaction, change of mind, reduced use, account inactivity, unused plan capacity or an account action resulting from a rule violation is not a refund basis.

Payment processing is provided by a third-party payment provider. Its own terms and privacy practices may apply to payment information it handles.

8. Intellectual property and copyright

Tobeho and its software, design, branding and service content, excluding user content, are owned by or licensed to TOBEHO LLC. You may not copy, reverse engineer, sell or exploit them except as permitted by law or with written permission.

Copyright complaints can be submitted through the Copyright/DMCA page or to dmca@tobeho.com. Misuse of the copyright process may lead to rejection or other appropriate action.

9. Third-party services and links

Tobeho may use third-party providers for hosting, payments, email delivery and similar operational services. User profile links may lead to third-party sites. Tobeho does not control those sites and is not responsible for their content or practices.

10. Changes and availability

We may add, change, suspend or discontinue features, subject to applicable law. We do not promise that the service will always be available, error-free or compatible with every device. Planned maintenance, security events and circumstances outside our reasonable control may affect availability.

11. Disclaimers

To the maximum extent permitted by law, Tobeho is provided on an “as is” and “as available” basis. We do not endorse or guarantee the accuracy, fairness or usefulness of user ratings or other user content.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, TOBEHO LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, reputation, profits or opportunities arising from use of the service. Any liability that cannot be excluded will be limited only to the extent permitted by applicable law.

13. Governing law and courts

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Except where mandatory applicable law provides otherwise, disputes arising from these Terms or the service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

14. Changes to these Terms

We may update these Terms. The current version and effective date will be shown on this page. When appropriate, we may also provide notice by email or through the service. Continued use after an update is subject to applicable law and any notice or re-acceptance requirements we state.
